Important Limitations for GIA Reports and their Facsimiles



A GIA Report is not a guarantee, valuation or appraisal, and GIA makes no representation or warranty regarding its Reports, the articles described therein or any inscription thereon. A GIA Report contains only the characteristics of an article described after it has been graded, tested, examined, and analyzed (collectively, “examination” or “examined”), using the techniques and equipment used by GIA at the time of the examination. The results of any other examination performed on the article may differ depending upon (i) when, how and by whom the article is examined and (ii) the changes and improvements in techniques and equipment that may have occurred which may enable the examiner to detect, among other things, the use of processes for altering the characteristics of an article which use was previously undetectable by GIA, or alterations which became reversible, even if the process remains undetectable. The trademark, service mark, logo, words, characters or other symbols of an inscription, other than a GIA Report number, or a GIA trademark, service mark or logo, are solely determined by and attributable to the Client for whom the Report was prepared and are neither attributable to nor to be understood as an indication of any determination by GIA.

GIA can provide its Reports and can make an inscription for a relatively small fee compared to the present and potential value of the article described therein only because the Report and any inscription are subject to the following limitations on the liability of GIA and the limitations described in the agreements by which the Report and any inscription are made, all of which extend to the Client for whom the Report and any inscription were prepared and to every other person to whom the Report or the inscribed article is distributed or shown:

(1) GIA AND ITS EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR EXPENSE RESULTING FROM ANY ERROR IN OR OMISSION FROM THE REPORT OR FROM THE ISSUANCE OF OR USE OF THE REPORT OR ANY INSCRIPTION, EVEN IF THE LOSS, DAMAGE OR EXPENSE WAS CAUSED BY GIA OR ANY OF ITS EMPLOYEES OR AGENTS AND (2) IN ANY EVENT, GIA AND ITS EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, STATUTORY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, RESULTING FROM ANY ERROR IN OR OMISSION FROM, OR FOR THE ISSUANCE OF OR USE OF, THE REPORT OR ANY INSCRIPTION, OR FOR ANY ERROR IN OR OMISSION FROM THE REPORT OR ANY INSCRIPTION CAUSED BY THE ACTS OF OTHERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

As a protection to the public and GIA, the Report, the name, trademarks, service marks and logos of Gemological Institute of America, Inc., or any part of any inscription which relates to a GIA Report number or to a Gemological Institute of America, Inc. trademark, service mark, or logo, may not be used in whole or in part for purposes of advertising, publicity or promotion, and the Report may not be referred to as a guarantee, certification, valuation or an appraisal.

ADDITIONAL LIMITATIONS FOR COPIES OF GIA REPORTS
A GIA® Report facsimile is not, and should not be considered, the GIA® Report. A PDF, shared, or printed version has no guarantee of including the most current grading information, which can be found only on reportcheck.GIA.edu.
 


GIA Report Access Card Terms of Use

Your use of GIA digital materials prepared with reference to a particular gem, including but not limited to the GIA Diamond Dossier®, Report Access Card, GIA Diamond Grading Report, and the GIA Laboratory-Grown Diamond Report (the “Support Materials”) is subject to these Program Terms, the GIA Website Terms of Use, and the Terms and Conditions of Sale (collectively, the “GIA Terms”), which are incorporated by reference into these Program Terms. The GIA Terms are a legal contract between the Gemological Institute of America, Inc. and affiliates (“GIA,” “We” or “Us”) and you (“You,”), and govern your (“Your”) use of any Support Materials and GIA® marks. In the event of a conflict between the Program Terms and the GIA Terms, the Program Terms shall govern with respect to the Support Materials.

USAGE GUIDELINES

 

In these Program Terms We are granting You a limited, non-exclusive and non-transferable license to download and display on Your website, include in your pdf documents, or transmit via email Support Materials for a product that You own or are offering for sale. Usage of all Support Materials must also follow the usage guidelines as outlined below.

You represent and warrant that You are fully responsible for ensuring that the Support Materials are at all times used and displayed in accordance with these Terms, including by any authorized personnel or agents, or any other third parties whom You permit to access, use or display the Support Materials and Tools. You acknowledge that GIA, in its sole discretion at any time, may require You to immediately modify, remove, or delete any use of the Support Materials.

Appropriate Use of Support Materials
 

  • You will at all times accurately represent the GIA Support Materials as being the property of GIA. 
  • You may use the Support Materials to make factual references to GIA and its education, research, laboratory services, academic credentials, and grading and identification reports, provided such references are accurate, are not likely to cause confusion, mistake, or deception, and do not imply, on your part, an affiliation with, connection to, or association with GIA or an endorsement by GIA.
  • You may download and display on Your website, include in your pdf documents, or transmit via email Support Materials for a product that You own or are offering for sale. The Support Materials may not be edited, excerpted or altered in any manner, and the image must represent the composition and content of the Support Materials.
  • You may resize Support Materials based on Your marketing needs, provided any GIA logo on the Support Materials is not larger than 50% of the size of Your logo appearing on the same page and is positioned separate and away from Your logo at least 500 pixels away, and an empty space of at least .3 inches is included around the entire card when printing, etc. (so as to not cause confusion, mistake, or deception, or imply an affiliation with, connection to, or association with, or endorsement by GIA). 

Prohibition on Use of Support Materials

You will not, and will not permit your end users or others acting on your behalf to, do the following with Support Materials:
 

  • Display or distribute any Support Materials or other data or information pertaining to a graded gemstone that is inaccurate, false, fraudulent or misleading in any manner;
  • Represent or imply that data or information pertaining to a graded gemstone is the subject of Support Materials when it is not;
  • Display or distribute any data or information pertaining to a graded gemstone from a source that is not GIA in combination with any GIA Support Materials in such a manner that there is the potential for such data or information to be construed as being GIA content or otherwise sourced from GIA;
  • Change or modify in any way (other than resizing as set forth above) the Support Materials;
  • Use any Support Materials, GIA content, GIA marks (including without limitation logos), or the terms GIA or Gemological Institute of America in any manner that implies an endorsement by GIA, or an affiliation with, connection to, or association between GIA and You;
  • Misrepresent the source or ownership of Support Materials;
  • Use any Support Materials in any way that is misleading, inaccurate, or inappropriate, or contrary to their intended use; or
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices; or falsify or delete any author attributions, legal notices, or other labels of the origin or source of material, including without limitation the Support Materials.

GIA can provide its Support Materials for a relatively small fee compared to the present and potential value of the article described therein only because the Support Materials are subject to the following limitations on the liability of GIA and the limitations described in the agreements by which the Support Materials are made.  You agree that:

(1) GIA AND ITS EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR EXPENSE RESULTING FROM ANY ERROR IN OR OMISSION FROM THE SUPPORT MATERIALS OR FROM THE ISSUANCE OF OR USE OF THE SUPPORT MATERIALS, EVEN IF THE LOSS, DAMAGE OR EXPENSE WAS CAUSED BY GIA OR ANY OF ITS EMPLOYEES OR AGENTS AND (2) IN ANY EVENT, GIA AND ITS EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, STATUTORY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, RESULTING FROM ANY ERROR IN OR OMISSION FROM, OR FOR THE ISSUANCE OF OR USE OF, THE SUPPORT MATERIALS, OR FOR ANY ERROR IN OR OMISSION FROM THE SUPPORT MATERIALS CAUSED BY THE ACTS OF OTHERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You further agree that you will indemnify GIA and its employees and agents against any loss, damage, or expense arising from any claim by any party to whom you distribute or show the Support Materials, even if the loss, damage or expense was caused by GIA or its employees or agents.

As a protection to the public and GIA, the Support Materials, the name, trademarks, service marks and logos of Gemological Institute of America, Inc., or any part of the Support Materials which relates to a Gemological Institute of America, Inc. trademark, service mark, or logo, may not be used in whole or in part for purposes of advertising, publicity or promotion, and the Report may not be referred to as a guarantee, certification, valuation or an appraisal.

Copies of Support Materials are not, and should not be considered, the actual documents. An image, PDF, shared, or printed version is not guaranteed to include the most current grading information for a particular gem, which can be found only on reportcheck.GIA.edu.
